<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">From an income tax perspective, if you are eligible to deduct automobile expenses from either your business or employment income the deductions available over time are the same. </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">What you spend on the cost of your car is deducted at a rate decided upon by the Canada Revenue Agency (CRA). The deduction is called Capital Cost Allowance or you may know it better as depreciation. So long as you purchase a car, new or used, for $30,000 or less before PST and GST, you can deduct 15% of the cost in the year you buy the car and 30% of the declining balance for every year after that. Based on this formula, eventually, you will claim 100% of the cost of your car. If you purchase a car for more than $30,000 you will not be able to make a claim on any excess amount paid. However, if you have a loan on the car purchased, you will be eligible to deduct the interest paid on the loan to a maximum of $300 per month of interest charges.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">If you lease your car, you are able to deduct the monthly lease payments so long as they do not exceed $800 per month plus PST and GST. In rare cases it may be lower but in general, CRA sets the limits ensure that the level of deductions for leased automobiles is similar to that for purchased ones. The detriment in a lease is that the initial down payment many people make, or are required to make, is not deductible at all for this calculation.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">The above being the case, the benefit of one over the other hinges on the timing of your purchase, the type of car owner you are or would like to be, and your overall financial circumstances.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">The timing of the purchase is important, as a purchase on December 31 of a year will result in the same deduction available as a purchase on January 1 of the same year. On the other hand, a lease entered into earlier in the year will result in more months of payments and thus a higher deduction for the year versus a lease entered into in December will result in no deduction as no payments have been made on the lease for the year.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">The type of car owner that you are is important because you may be a person who drives few kilometres in a year and enjoys driving a new car. Why not then lease a car and in effect rent a new car all the time! However, if you drive a car until it’s dead, you should always buy your car as your cost of leasing will far outweigh your borrowing costs in the long run. Let’s take the example of a car that costs you $500 per month on a lease, no down payment and a buy out after 3 years of $10,000. If you can buy this same car for $25,000 with 0% financing, you would save yourself $3,000 and that is assuming, you don’t drive over the allowable kilometres in the year and have the $10,000 sitting in the bank in 3 years!</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">Finally, you’re over all financial circumstances may dictate what you should do. Using the above example, if your 0% financing is only for 3 years, your monthly payments would be $694 per month. If you do not have the extra $194 to spend on a car payment, then your only option is to lease.</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;">Now that you know if you should buy or lease your car and what portion of those costs you can use for your deduction calculation, keep in mind that the final tax write off will be limited to the business use of the vehicle versus the personal use. If you use your car 80% of the time for business, only 80% of your monthly lease payments or your annual depreciation plus interest is deductible for tax purposes</span></span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-family:Tahoma;"><span style="font-size:small;"> </span></span></p>

<p class="MsoNormal" style="margin:0;"><span style="font-size:10.5pt;color:#003366;font-family:Arial;">When a person declares bankruptcy the Office of the Superintendent of Bankruptcy notifies the credit bureau. This information stays on your credit bureau report for 6 years after the date of your discharge. A proposal stays on your credit bureau report for 3 years after your proposal was completed. You can start to re-establish your credit by doing the following: </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:10.5pt;color:#003366;font-family:Arial;"> </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:10.5pt;color:#003366;font-family:Arial;">Talk to your banker and say you want to re-establish your credit rating; </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:10.5pt;color:#003366;font-family:Arial;">Open a savings account; </span></p>
<p class="MsoNormal" style="margin:0;"><span style="font-size:10.5pt;color:#003366;font-family:Arial;">Be a regular and persistent saver.<span>  </span>Use the common techniques I am sure you have heard of:<span>  </span></span></p>

<p><strong>Answer:</strong> One of the easiest, most effective ways to start building a credit history is to get a Canadian credit card. If you do not have a credit history, you may benefit from a secured credit card. With these types of cards, you decide how much credit you think you’ll need or can afford, and then deposit that amount with the bank as security. This amount becomes your credit limit.</p>
<p>For most people, all you need to do is bring some personal information and identification into a bank branch, where a bank representative can get you started on your credit card application.<br />

<p>They want to pay their creditors and are in my office exploring their financial options. The couple has heard of a program called Orderly Payment of Debts (OPD) and want to know how it can be of help to them.</p>
<p>Unfortunately, the OPD program has become a victim of B.C. government cuts.The OPD program has provided more debtors with unbiased financial information than any other financial service to date. The program&#8217;s closure will cast thousands of poor individuals and vulnerable families to the yellow pages.</p>
<p>These people will soon be phoning trustees or credit counsellors, only to find that there is little in the way of services available to them.</p>
<p>OPD has been in existence since the late 1960s. In 1975, as a loans officer at Vancouver City Savings Credit Union, I made what would be the first of many referrals to the counsellors at OPD. For a period of 16 years, the OPD program was essentially the only credit-counselling service available to debtors.</p>

<p>As the national consumer debt expanded from $41 billion in 1980 to over $100 billion in 1990, B.C. could not keep up with the demand for alternatives to bankruptcy. Private-sector credit counselling services began appearing and have worked alongside the OPD program ever since. With the changes to the Bankruptcy and Insolvency Act in 1992, the Trustees in Bankruptcy began offering consumer proposals for debtors.</p>
<p>There have been growing pains with private-sector competition in the industry, as well as the occasional belief that the OPD program was &#8220;stealing business&#8221; away from both trustees and credit-counselling companies. However, there is no financial profit to be found in OPD&#8217;s activities.</p>
<p>In the beginning, OPD offered a service to the over-committed debtor where the program received little or zero profit. In recent years OPD has responded to newer casualties of the credit society — such as the student loan crisis, leaky condos and growing tax liabilities for individuals and families.</p>
<p>Once again, there is little financial profit to be uncovered.</p>
<p>In 1998, the OPD program split away from the consumer portfolio and the regulatory function of debt collection and credit reporting. OPD began to focus on separating families and providing mediation and counselling services at no cost to the debtor, creditor, or the family court. This initiative served to place the OPD program even farther away from the insolvency business and in the heart of another great social tragedy, the struggling family unit.</p>
<p>Once again, there is little, if any money to be made here.</p>
<p>With the closure of the OPD program, our industry will quickly discover how many free services were available in the past to people who are financially challenged.</p>
<p>Often people with severe financial problems are afraid and angry, and at times they can be belligerent. Starting April 30, there is no longer a destination to refer these unfortunate people to.</p>
<p><strong>What is the cost of closing the OPD program?</strong><br />
The closure of the OPD program will increase credit counsellor&#8217;s costs, as many people turn to us for financial guidance and support.</p>
<p>Secondly, credit counsellors will lack a long-standing valuable resource, where, if all else failed, they could always send clients down to OPD.</p>
<p>Thirdly, there will be an increase in bankruptcy assignments for the poor and financially vulnerable. Possibly in the future, there may even be a need to create a new type of bankruptcy assignment to accommodate those who lack the ability to pay the bankruptcy fees.</p>
<p>Ministry statistics over the years have clearly established that the vast majority of clients for the OPD program need access to credit information. This information includes what constitutes harassment under the Debt Collection Act, what constitutes a proper and improper seizure of assets, what credit ratings are and how long will it affect the debtor, and many more questions and issues.</p>
<p>The OPD program has always provided the consumer with a great deal of information regarding bankruptcy itself, that will now undoubtedly come to credit counsellors and bankruptcy trustees.</p>
<p>Yes there may be new opportunities, but by and large, OPD has been a unique and special service in BC.</p>
<p>I am not alone as I mourn the death of the OPD in B.C. On behalf of the hundreds of clients I have referred to OPD over the last 27 years, I wish to extend a special thank you to Mr. Doug Welbanks, director of the Debtors Assistance Program and his excellent staff &#8211; you will be missed.</p>
